• Application refers to Amp’d, the mobile application provided by the Company.

• Device means any device that can access the Service, such as a smartphone or tablet.
• Personal Data is any information that relates to an identified or identifiable individual.
• Service refers to the Application and the support website located at ampdfit.app.
• Service Provider means any natural or legal person who processes the data on behalf of the Company (e.g., Formspree for contact form processing).
• Usage Data refers to data collected automatically, such as anonymous diagnostics and crash reports provided by Apple.
• You means the individual accessing or using the Service.

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data. While using Our Service, We may ask You to provide Us with certain personally identifiable information that can be used to contact or identify You, including:

• Email address and message contents if You contact support via form or email.
• Optional information You may choose to provide in Your message (e.g., name, device model, OS version).

Workout & Progression Data. When You log workouts in the App (e.g., exercises, sets, reps, weights, rest times, notes), this information is stored locally on Your Device and is not transmitted to Our servers.

Usage Data. When using the Service, anonymous diagnostics such as crash logs may be provided by Apple to help Us improve performance and stability. If You enable a music integration (e.g., Spotify), the App may request limited playback permissions strictly to control in-app audio; We do not access Your Spotify password or personal listening history.

Tracking Technologies and Cookies

The Application does not use cookies. The support Website may use minimal Cookies (e.g., to remember cookie consent). You can instruct Your browser to refuse Cookies; some Website features may not function without them.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

• To provide and maintain the Service, including enabling workout logging and progression tracking on Your Device.
• To contact You to respond to support requests You submit.
• To manage Your requests and improve customer support.
• To improve the Service using anonymous diagnostics and crash reports.
• For legal compliance and to protect against fraud or abuse.

We do not sell or rent Your Personal Data.

Sharing Your Personal Data

We may share limited information in the following situations:

• With Service Providers that process support submissions (e.g., Formspree) solely to operate the contact form and deliver Your message to Us.
• For business transfers in connection with a merger, acquisition, or asset sale (You will be notified before any change of controller).
• For legal reasons to comply with law or valid requests by public authorities.
• With Your consent for any other purpose disclosed at the time of collection.

Retention of Your Personal Data

• Workout & progression data remain on Your Device until You delete them or uninstall the App (unless preserved in device backups).
• Support messages are retained in Our support inbox for as long as necessary to resolve Your request and for limited archival, unless You request deletion.
• Anonymous diagnostics are retained by Apple under its own policies.

Transfer of Your Personal Data

We do not transfer Your workout/progression data to Our servers. Contact submissions may be processed by Service Providers or email providers that operate in other countries; We take reasonable steps to ensure appropriate protections are in place.

Delete Your Personal Data

You may delete workouts and progression history from within the App at any time. Uninstalling the App removes locally stored data (subject to device backups). To request deletion of support messages You sent to Us, contact support@ampdfit.app.

Disclosure of Your Personal Data

Business Transactions. If the Company is involved in a merger, acquisition, or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law Enforcement. Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities.

Other Legal Requirements. The Company may disclose Your Personal Data in the good-faith belief that such action is necessary to comply with a legal obligation; protect and defend the rights or property of the Company; prevent or investigate possible wrongdoing; protect the personal safety of Users or the public; or protect against legal liability.

Security of Your Personal Data

The security of Your Personal Data is important to Us. We use reasonable technical and administrative safeguards and rely on iOS device-level protections (such as device encryption). However, no method of transmission or storage is 100% secure.

Children’s Privacy

Our Service is not directed to anyone under the age of 13. We do not knowingly collect Personal Data from children under 13. If You believe a child has provided Personal Data, please contact Us so we can delete it.

Our Service may contain links to other websites not operated by Us. We have no control over and assume no responsibility for their content or privacy practices. We encourage You to review their privacy policies.

License. When You purchase Amp’d, You receive a personal, non-transferable license to use the App on Your devices.

Purchases & refunds. Transactions are handled by Apple and subject to App Store policies.

Liability. To the maximum extent permitted by law, Edward O’Brien is not liable for indirect, incidental, special, or consequential damages arising from use of the App.
